Mr H appeared at Barnstaple Magistrates’ Court facing a charge of being drunk in charge of a vehicle. He pleaded guilty to the offence and faced a potential disqualification period of 12 months.

Mitigation was put forward detailing how any disqualification would have a devaluating effect on his employment and thereby his family’s well being also. The court heard how he was the main income provider.

The Magistrates were persuaded by the submission and decided to deal with the case by way of 10 penalty points rather than a period of disqualification.
